1. Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of the games, applications, websites and other services operated by or on behalf of Dogancan Ozyildiz Games (collectively, the "Services"). By downloading, installing, accessing or using any of the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree to these Terms, please do not use the Services.
2. License to Use the Services
Subject to your compliance with these Terms, Dogancan Ozyildiz Games grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to download and use the Services for your own personal, non-commercial entertainment purposes. All rights not expressly granted to you are reserved by Dogancan Ozyildiz Games and its licensors.
3. Eligibility
The Services are not directed to children under the age of 13 (or under 16 in certain jurisdictions in the European Union). By using the Services, you represent that you are old enough to do so under the laws of your country, or that you have the consent of a parent or legal guardian. If you are using the Services on behalf of a minor, you accept these Terms on their behalf and are responsible for their use of the Services.
4. Your Account
Some Services may allow or require you to create an account or to sign in through a Third-party platform such as Apple Game Center. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use of your account. We are not liable for any loss arising from your failure to safeguard your credentials.
5. Acceptable Use
When using the Services, you agree that you will not:
- Cheat, exploit bugs, or use unauthorized third-party software, bots, or automation to gain an unfair advantage;
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Services, except to the extent permitted by law;
- Modify, adapt, or hack the Services or interfere with their normal operation, servers, or networks;
- Use the Services for any unlawful purpose or in violation of any applicable law or regulation;
- Harass, threaten, defame, or abuse other players, or post content that is unlawful, offensive, or infringing;
- Sell, trade, or transfer your account or virtual items outside of the Services where prohibited;
- Access the Services through means we have not authorized.
We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this section, including removing content, suspending or terminating accounts, and reporting activity to law enforcement.
6. Virtual Items and Purchases
The Services may offer virtual items, virtual currency, or other digital content ("Virtual Items") that you can purchase or earn. Virtual Items are licensed to you, not sold, and have no monetary value and cannot be exchanged for real money or goods except where required by law.
All purchases are processed by the applicable app store (such as the Apple App Store or Google Play), and are subject to that store's terms and payment policies. Except where required by law, all purchases are final and non-refundable. Requests for refunds must generally be made through the relevant app store. We do not store or have access to your full payment card details.
We may manage, regulate, control, modify, or eliminate Virtual Items at any time, with or without notice. We will not be liable to you or any Third Party if we exercise any such rights.
7. User Content
The Services may allow you to submit content such as messages, names, feedback, or other materials ("User Content"). You retain ownership of your User Content, but you grant Dogancan Ozyildiz Games a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, distribute, and display that User Content in connection with operating and improving the Services. You are solely responsible for your User Content and represent that you have the rights necessary to submit it.
8. Intellectual Property
The Services, including all games, software, artwork, characters, audio, text, and other materials, are owned by Dogancan Ozyildiz Games or its licensors and are protected by copyright, trademark, and other intellectual property laws. Except for the limited license granted to you in these Terms, nothing gives you any right, title, or interest in the Services. You may not use our name, logos, or trademarks without our prior written permission.
9. Third-party Services
The Services may integrate or interoperate with Third-party platforms, advertising networks, analytics providers, and app stores. Your use of those Third-party services is governed by their own terms and privacy policies. Dogancan Ozyildiz Games is not responsible for the content, policies, or practices of any Third-party service, and your dealings with them are solely between you and the Third Party.
10. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Services. You may stop using the Services at any time by deleting the applications from your devices. Provisions that by their nature should survive termination — including intellectual property, disclaimers, and limitation of liability — will survive.
11. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Dogancan Ozyildiz Games does not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components, or that any defects will be corrected. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Dogancan Ozyildiz Games and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the Services. To the extent liability cannot be excluded, our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the claim or ten U.S. dollars (USD $10). Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
13. Changes to the Services and Terms
We may modify, update, suspend, or discontinue the Services, in whole or in part, at any time. We may also revise these Terms from time to time. If we make material changes, we will update the "Effective Date" above and, where appropriate, provide additional notice. Your continued use of the Services after changes become effective constitutes your acceptance of the revised Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of Turkey, without regard to its conflict-of-laws principles. Any disputes arising out of or in connection with these Terms or the Services will be subject to the jurisdiction of the courts of Turkey, except where mandatory consumer protection laws of your country of residence provide otherwise.
